ජනාධිපතිට ජනමතවිචාරණයක් පැවැත්විය හැකිද?

ජනාධිපතිතුමාට ඕනෑම ජාතික වැදගත්කමක් ඇති කරුණක් ගැන ජනමතවිචාරණයක් පැවත්වීම ගැන  දැක්වෙන්නේ ආණ්ඩු ක්‍රම ව්‍යවස්ථාවේ XIII වැනි පරිච්ඡේද‍යේ 86 වැනි ව්‍යවස්ථාව යටතේයි. එනම් -  

The President may, subject to the provisions of Article 85, submit to the People by Referendum any matter which in the opinion of the President is of national importance.

මෙතැන වැදගත් කරුණ නම් ජනමතවිචාරනය පැවැත්විය යුත්තේ 85 වැනි ව්‍යවස්ථාවේ විධිවිධානවලට යටත්ව බවයි. දැන් 85 වැනි ව්‍යවස්ථාවේ සඳහන් වන්නේ කුමක්දැයි බලමු - එය වගන්ති 2 කින් යුතුය (එක් වගන්තියක් 19 වැනි සංශෝධනයෙන් ඉවත් කර ඇත)

85. (1) The President shall submit to the People by Referendum every Bill or any provision in any Bill    which  the Cabinet of Ministers has certified as being intended to be submitted to the People by Referendum, or which the Supreme  Court has determined as requiring the approval of the People at a Referendum if the number of votes cast in favour of such Bill amounts to not less than two-thirds of the whole number of Members (including those not present).

 (3) Any Bill or any provision in any Bill submitted to the People by Referendum shall be deemed to be approved by the People if approved by an absolute majority of the valid votes cast at such Referendum : Provided that when the total number of valid votes cast does not exceed two-thirds of the whole number of electors entered in the register of electors, such Bill shall be deemed to be approved only if approved by not less than one-third of the whole number of such electors.

මෙහි 85(1) සඳහන් වන්නේ කුමක්ද? ජනාධිපතිවරයාට අනුව ජාතික වැදගත්කමක් ඇති යෝජනාවක් වුවද එය ජනමතවිචාරණයක් සඳහා ඉදිරිපත් කිරීමට පෙර  අමාත්‍ය මණ්ඩලයේ අනුමැතිය ලැබුනු පසුවද පාර්ලිමේන්තුවේ සියළු මන්ත්‍රීවරුන්ගේ (නොපැමිණි අයද සමඟ) 2/3 ක බහුතරයක් ලබා ගත් යුතුය

අනිත් වචනවලින් කිවහොත් වර්තමාන ජනාධිපති ‍මෛත්‍රීපාල සිරිසේනට ජනමතවිචාරණයක් වෙත යාමේ හැකියාවක් නොමැත
